Terms of Service

DRAFT — to be reviewed by the studio's lawyer. This starter text describes what the software stores and does; it is not legal advice and is not final.

Terms of Service

Version 2026-10-23-draft

These terms apply when you use the member portal, the member app, online booking and payment of the studio ("the Studio"), and — in section 9 — when a business signs up to run its studio on FitCore. By ticking "I accept" when you activate your access or sign up, you agree to them and to the Privacy Policy.

1. Your account

  • Your account is for you alone. Keep your password and the sign-in codes sent to your mobile private; tell the Studio at once if you think someone else has used your account.
  • You can sign in with your e-mail and password, or with your mobile number and a one-time SMS code when the Studio offers it. Keep the mobile number on your membership up to date: whoever holds that number can receive the sign-in code.
  • Give correct details, and update them in the app or at the front desk when they change.

2. Memberships and packages

  • Each membership or package has the price, validity, number of sessions and studios shown when you buy it. Unused sessions expire at the end of the validity unless the Studio extends them.
  • Freezes, transfers, upgrades and cancellations follow the Studio's policy at the time; you can request a freeze or cancellation in the app where the Studio allows it, and the Studio decides it.
  • [Studio to add: its refund policy, joining fees and any minimum term.]

3. Bookings, cancellations and check-in

  • Classes and appointments can be booked and cancelled until the cut-off shown in the app. A late cancellation or a no-show may use up the session or carry a fee, as the Studio's booking rules say.
  • When a full class has a waitlist, freed places go to the waitlist in order, as the app shows.
  • Check in at the desk or kiosk on arrival. Do not share your kiosk PIN.

4. Payments, invoices and dues

  • Prices include or add GST as shown. You receive an invoice or receipt for every payment.
  • Online payments are processed by Razorpay under its own terms; the Studio never sees your full card number.
  • Amounts due on your account must be paid by the date shown. [Studio to add: what happens when dues are not paid.]

5. Health and safety

  • Tell the Studio about any health condition, injury or pregnancy that may affect your training, and check with a doctor before you start if you are unsure. Keep your health notes current.
  • Follow the trainers' instructions and the Studio's rules on the floor. Exercise carries a risk of injury; train within your limits.
  • [Studio's lawyer to add: assumption of risk and liability wording for the Studio's premises.]

6. Acceptable use

  • Do not misuse the app or website: no attempts to access other people's accounts or data, to break or overload the service, or to post unlawful or abusive content in reviews or messages.
  • The Studio may suspend an account that breaks these terms, after telling you why where it can.

7. Messages from the Studio

You will receive service messages about your bookings, payments and membership by SMS, e-mail, WhatsApp or app notification. Offers and news are sent only with your consent, and you can stop them at any time (see the Privacy Policy).

8. The service

  • We work to keep the app and website available, but they may be briefly unavailable for maintenance or for reasons outside our control.
  • [Lawyer to add: limitation of liability, governing law (India) and the courts with jurisdiction.]

9. For studios that sign up for FitCore

  • The business that signs up (the "Customer") is responsible for the personal data of its members and staff that it enters or imports, and for having a lawful basis — including any consent needed — for it. FitCore processes that data only on the Customer's instructions, to provide the service.
  • The Customer keeps the sign-in details of its staff secure, gives each person their own login and the least access their work needs, and removes access when someone leaves.
  • The Customer is responsible for its own prices, tax settings, invoices and the messages it sends to its members, and for following the rules of the providers it connects (payment, SMS, e-mail, WhatsApp, accounting).
  • New sign-ups start on a trial; continued use after the trial needs a paid plan. [To add: fees, billing, data export and deletion on exit, and the data processing terms between the Customer and FitCore.]

10. Changes and contact

When these terms change we publish the new version here with a new version number and ask you to accept it again where needed. Questions: contact the Studio, or the Grievance Officer named in the Privacy Policy.
